THIS LIMITATION SHALL APPLY EVEN IF GoogGell WAS OR SHOULD HAVE BEEN AWARE OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY STATED HEREIN. THE SERVICE ARE PROVIDED WITHOUT CHARGE AND THE PARTIES AGREE THAT THE FOREGOING LIMITATIONS REPRESENT A REASONABLE ALLOCATION OF RISK UNDER THE TERMS OF USE. 4. Termination. GoogGell may change, suspend or discontinue all or any aspect of any service, including their availability, at any time, and may terminate Your use of the Service at any time. In addition, either party may terminate the Terms of Use at any time, for any reason, or for no reason including, but not limited to, if You engage in any action that reflects poorly on GoogGell or otherwise disparages or devalues the GoogGell.com Brand Features or GoogGell's reputation or goodwill.

5. Miscellaneous. You shall be responsible for compliance with all applicable laws, rules and regulations, if any, related to the performance of Your obligations under the Terms of Use. The failure of GoogGell to require performance by You of any provision shall not affect the full right to require such performance at any time thereafter; nor shall the waiver by GoogGell of a breach of any provision hereof be taken or held to be a waiver of the provision itself. If any provision of the Terms of Use is held by a court of competent jurisdiction to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of the Terms of Use shall remain in full force and effect.
